In December 2023, a complaint was filed against or in reference to Brian Mariash by a customer of Merrill Lynch, Pierce, Fenner & Smith Incorporated alleging that Mr. Mariash was not acting in the client’s best interest from 2/24/2020-12/08/2023 regarding equity indexed annuities and variable annuities. As of this publication date, the claim remains pending.

In January 2009, a complaint was filed against or in reference to Brian Mariash by a customer of A.G. Edwards & Sons, Inc. alleging that the client had been paying for a GMIB rider since purchasing the contract in 2004 and was recently advised she does not have the rider. On July 15, 2016, Mr. Mariash settled the claim for $7,708.06, and some or all of this amount may have been paid by Mr. Mariash’s employer and/or insurance carrier.

In November 2007, a complaint was filed against or in reference to Brian Mariash by a customer of Morgan Stanley & Co. Incorporated alleging improper IRA distribution leading to tax penalties. Per the customer, he/she lost over $200,000 because of Mr. Mariash’s actions. On June 14, 2010, Mr. Mariash settled the claim for $40,000, and some or all of this amount may have been paid by Mr. Mariash’s employer and/or insurance carrier.
