In July 2020, a FINRA arbitration was filed against or in reference to Scott Barcomb by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that the investments the client purchased in 2014-2015 were high risk and not consistent with her risk tolerance. The client also alleges the firm failed to supervise the activity of the representative and failed to conduct adequate due diligence. On December 2, 2021, Mr. Barcomb settled the claim for $10,000, and some or all of this amount may have been paid by Mr. Barcomb’s employer and/or insurance carrier.

In August 2010, a complaint was filed against or in reference to Scott Barcomb by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that Mr. Barcomb did not advise correctly on taxes involved when taking disbursements from partial 1035 exchanged contracts. Per the customer, he/she lost over $116,657 because of Mr. Barcomb’s actions. On January 19, 2012, Mr. Barcomb settled the claim for $20,000, and some or all of this amount may have been paid by Mr. Barcomb’s employer and/or insurance carrier.

In June 2010, a FINRA arbitration was filed against or in reference to Scott Barcomb by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that Mr. Barcomb failed to conduct an adequate due diligence examination of the tenants-in-common property that was sold. Per the customer, he/she lost over $600,000 because of Mr. Barcomb’s actions. On June 1, 2011, Mr. Barcomb settled the claim for $200,000, and some or all of this amount may have been paid by Mr. Barcomb’s employer and/or insurance carrier.

In March 2008, a complaint was filed against or in reference to Scott Barcomb by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that Mr. Barcomb did not cancel the client’s investment in an annuity after she made the request. Per the customer, he/she lost over $10,242 because of Mr. Barcomb’s actions.

In November 2006, a FINRA arbitration was filed against or in reference to Scott Barcomb by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that the client was advised to sell one variable annuity to fund the purchase of another variable annuity with a guaranteed income rider causing penalty charges which the client wanted refunded. Per the customer, she lost over $15,000 because of Mr. Barcomb’s actions. On November, 2007, Mr. Barcomb settled the claim for $10,000, and some or all of this amount may have been paid by Mr. Barcomb’s employer and/or insurance carrier.

In October 1999, felony charges were pressed against Scott Barcomb in Sarasota County Circuit Court for Sarasota, Florida. Mr. Barcomb received 1 count of felony for fleeing to elude and 1 felony count for possession of $20 of cocaine.
