In September 2022, a complaint was filed against or in reference to Kimsey Hollifield by a customer of Alphastar Capital Management, LLC alleging that Mr. Hollifield misrepresented the terms and made an unsuitable recommendation related to the purchase of a Structured Note. The note was subsequently rescinded by the issuing bank, and client requested to participate in the rescission offer; however, financial advisor failed to submit client’s request for rescission during the 30-day window for the rescission offer. Mr. Hollifield moved to a new advisory firm and failed to disclose affiliation with the new firm to the client during a client meeting. Per the customer, he/she lost over $35,499 because of Mr. Hollifield’s actions. On September 22, 2022, Mr. Hollifield settled the claim for $6,780.82, and some or all of this amount may have been paid by Mr. Hollifield’s employer and/or insurance carrier.
