Swassing disclosed the prospective venture to his broker twice in 2005, but his requests to participate were “disapproved.” the venture agreement involved investing in unimproved land in NYE county, Nevada. The total purchase price of the property was $155,000 with the clients providing $150,000 of investment capital.

In December 2020, a complaint was filed against or in reference to Frank Swassing III by a customer of LPL Financial LLC alleging that Mr. Swassing III solicited purchase of shares in a joint venture for purchase of real estate in 2006, client requests refund of $100,000 purchase amount provided to advisor.
