In June 2003, a complaint was filed against or in reference to Thomas Endersbe by a customer of American Express Financial Advisors alleging that Mr. Endersbe failed to disclose CDSC when the client purchased B-share mutual funds in 2001. She requested the charges be waived. Per the customer, she lost over $11,641 because of Mr. Endersbe’s actions. On July 31, 2003, Mr. Endersbe settled the claim for $4,175, and some or all of this amount may have been paid by Mr. Endersbe’s employer and/or insurance carrier.
