In December 2023, FINRA initiated a regulatory event against or in reference to Yann Faho. Without admitting or denying the findings, Faho consented to the sanctions and to the entry of findings that he caused his member firm to maintain incomplete books and records by using his personal mobile phone to communicate via text message with firm customers regarding securities-related business. The findings stated that these text messages included Faho seeking and obtaining authorization to buy and sell stocks, discussion of specific investment recommendations, provision of market updates, and conversations about account performance. Faho’s firm did not capture or maintain these test messages, as it was required to do under the Exchange Act and FINRA Rules.

In January 2021, a FINRA arbitration was filed against or in reference to Yann Faho by a customer of Aegis Capital Corp alleging poor performance. Per the customer, he/she lost over $180,000 because of Faho’s actions. On March, 2022, Faho settled the claim for $115,000, and some or all of this amount may have been paid by Faho’s employer and/or insurance carrier.

In August 2020, a FINRA arbitration was filed against or in reference to Yann Faho by a customer of Aegis Capital Corp alleging unauthorized trading, churning, breach of fiduciary duty, breach of contract, and unsuitable investments.
