In November 2023, FINRA initiated a regulatory action against or in reference to Brian Shey. Without admitting or denying the findings, Shey consented to the sanctions and to the entry of findings that he willfully failed to amend his Form U4 to disclose four felony charges. The findings stated that the State of Florida charged Shey with two felony counts of submitting a false insurance application and two felony counts of submitting a fraudulent insurance claim. Shey was aware of the felony charges but failed to amend his Form U4 within 30 days, or at any point during his association with his member firm. The charges were later dismissed.

In February 2019, a complaint was filed against or in reference to Brian Shey by a customer of Sterling Wyatt PA alleging breach of fiduciary responsibility and misrepresentation. As of this publication date, this claim remains pending.

In October 2008, a complaint was filed against or in reference to Brian Shey by a customer of Omni Financial alleging that Mr. Shey convinced the client to surrender his security mutual policy and purchase a Minnesota life policy. The client did and claims that Mr. Shey sold the policy as an investment type policy and did not disclose the much higher premiums, which he would not have agreed to. The client is also concerned about his cash value which is significantly less than when he purchased the Minnesota life policy. Per the customer, he lost over $5,000 because of Mr. Shey’s actions.
