In June 2020, a FINRA arbitration was filed against or in reference to Gordon Roberts Jr. by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that Mr. Roberts made a series of recommendations of illiquid, high-commission investments from 2009-2013 which were unsuitable and resulted in over-concentration in these products in their portfolio. In addition the client alleges the firm failed to conduct adequate due diligence relating to United Development Funding and was negligent. On December 29, 2021, Mr. Roberts settled the claim for $10,000, and some or all of this amount may have been paid by Mr. Roberts’s employer and/or insurance carrier.

In July 2019, a FINRA arbitration was filed against or in reference to Gordon Roberts Jr. by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that the investments the client purchased in 2008-2012 were unsuitable and misrepresented to him by the representative. The client also alleges the firm failed to supervise the actions of the representative and conduct adequate due diligence. On November 20, 2020, Mr. Roberts settled the claim for $325,000, and some or all of this amount may have been paid by Mr. Roberts’s employer and/or insurance carrier.

In January 2013, a FINRA arbitration was filed against or in reference to Gordon Roberts Jr. by a customer of Investment Planners, Inc. alleging that the investments were unsuitable and misrepresented to the client by the representative. The client also alleges the firm failed to supervise the actions of the representative. On June 30, 2014, Mr. Roberts settled the claim for $45,000, and some or all of this amount may have been paid by Mr. Roberts’s employer and/or insurance carrier.

In August 2010, a FINRA arbitration was filed against or in reference to Gordon Roberts Jr. by a customer of Investment Planners, Inc. alleging that Mr. Roberts was negligent, breached his fiduciary duties, and that the recommended transactions were unsuitable. Per the customer, he/she lost over $400,000 because of Mr. Roberts’s actions. On August 14, 2011, Mr. Roberts settled the claim for $52,500, and some or all of this amount may have been paid by Mr. Roberts’s employer and/or insurance carrier.

In October 2002, a complaint was filed against or in reference to Gordon Roberts Jr. by multiple customers of Investment Planners, Inc. alleging that in or about March, 2001, Mr. Roberts recommended the purchase of life insurance policies and that the funding would come from the clients’ IRA accounts. After the policies were in force for 8 or 9 months, the customers wanted their money back. Per the customers, they lost over $55,000 because of Mr. Roberts’s actions. On April 1, 2003, Mr. Roberts settled the claim for $30,000, and some or all of this amount may have been paid by Mr. Roberts’s employer and/or insurance carrier.
