In October 2020, a FINRA arbitration was filed against or in reference to James Malaussena by a customer of Berthel, Fisher & Company Financial Services, Inc. alleging that the client was not informed about the costs of the investments she made from 2000-2020 in mutual funds, annuities, and CDs. She alleges she was misled about the returns she received after the fees she incurred. In addition, the client questioned whether she incurred more in taxes as a result of the investment she selected. In January 2022, the client filed an arbitration which alleged an unsuitable investment strategy, misrepresentation of the investments, forgery of the client’s signature on some of the paperwork, and that the firm failed to adequately supervise the representative. As of this publication date, this claim remains pending.
In May 2004, a complaint was filed against or in reference to James Malaussena by a customer of TD Waterhouse Investor Services, Inc. alleging that the solicitation of $10,000.00 worth of Worldcom 7.68 Corts due 08/15/28 was unsuitable.
