In December 2005, a NASD arbitration was filed against or in reference to Richard Casolari by a customer of Mony Securities Corporation alleging that Mr. Casolari has been negligent and has breached his fiduciary duty. Further, the claimant added that Mr. Casolari violated the Illinois Securities Act arising from allocation decisions with respect to the claimant’s portfolio. Per the customer, they lost over $366,565.20 because of Mr. Casolari’s actions. On November 15, 2006, Mr. Casolari settled the claim for $115,000, although some or all of this amount may have been paid by Mr. Casolari’s employer and/or insurance carrier.
In July 2003, a NASD arbitration was filed against or in reference to Richard Casolari by a customer of Mony Securities alleging that Mr. Casolari made unsuitable recommendations, material misrepresentations, exercised discretionary power in the client’s account, and failed to material facts regarding the client’s investment.
