In May 2023, a complaint was filed against or in reference to Troy Talamelli by a customer of LPL Financial LLC alleging that the client account was rebalanced and discussed capital gain and tax implications based on an agreed recommendation to the client. Per transaction and rebalancing, the client was aware that capital gains would be incurred with this transaction. This was disclosed on a recorded line as well as in notes on the specific transaction in Salesforce. Managed accounts were aware of this transaction and it was disclosed that cost basis would be carried over to the new re-allocated model. Based on clients risk tolerance, time horizon, and long term goals, the recommendation was a suitable investment and this complaint is based solely on Capital Gains and Taxes that client was aware of. Per the customer, he/she lost over $7,500 because of Mr. Talamelli’s actions. On August 30, 2023, Mr. Talamelli settled the claim for $20,000, and some or all of this amount may have been paid by Mr. Talamelli’s employer and/or insurance carrier.
