In February 2019, a complaint was filed against or in reference to Wesley Foltz by a customer of LPL Financial LLC alleging that recommendation of REIT investment in December 2008 was unsuitable and seeks recovery of investment losses. Per the customer, he/she lost over $50,000 because of Mr. Foltz’s actions.

In November 2018, a complaint was filed against or in reference to Wesley Foltz by a customer of Prospera Financial Services, Inc. alleging that Mr. Foltz purchased REITS for the client’s account that were unsuitable. Per the customer, he lost over $5,000 because of Mr. Foltz’s actions.

In October 2018, FINRA initiated a regulatory action against or in reference to Wesley Foltz. Without admitting or denying the findings, Foltz consented to the sanctions and to the entry of findings that he recommended certain L-share variable annuities to his customers without a reasonable basis for believing that the recommendations were suitable. The findings stated that Foltz recommended that his customers buy higher-cost share class contracts and higher-cost riders without understanding the costs and benefits of these products. As a result of Foltz’s lack of understanding of the L-share variable annuity, he was unable to inform customers of the various features of the products he was recommending, including the potential surrender charges, expenses, and charges and features of riders.
